The City has now paid and/or mailed all amounts owed (backpay and liquidated damages) for the Caldwell Fire Inspector lawsuit settlement. We have talked with our attorneys, McGillivary Steele Elkin LLP, and you should receive your liquidated damages check within the next two weeks. If you do not receive it, or if you have moved since you signed up for the case, please contact the law firm at info@mselaborlaw.com. If you are a retiree or otherwise separated from City employment, you will not receive your backpay check until after you cash your liquidated damages check.
Our attorneys are now investigating claims for another overtime pay lawsuit for Fire Protection Inspectors and Associate Fire Protection Inspectors (“Fire Inspectors”). This 2025 Fire Inspector Lawsuit will include Fire Inspectors who were plaintiffs in Caldwell and those who did not sign up for Caldwell who have worked as Fire Inspectors for any workweek from March 15, 2022, to the present. If you want to sign up for this new case, please complete and submit the consent retainer attached here. If you are a plaintiff in Caldwell, while you are eligible to participate in this new lawsuit, your damages will commence on September 13, 2024, which is one day after the release of claims in Caldwell. If you were not in Caldwell, you can recover damages beginning three years back from when your claim is filed in court in the new lawsuit. The law firm anticipates that it will file the new Fire Inspector overtime lawsuit in the next month.
