Were you a plaintiff in Buder et al., v. City of New York?

If you were a plaintiff in Buder et al., v. City of New York, and have not yet cashed your liquidated damages check, please do so immediately!

If you are a retired or separated employee, or in an extended leave status, the City delivered your net backpay check to your attorneys’ firm on January 29, 2026.  They cannot mail those backpay checks until the liquidated damages/interest check is cashed to ensure the firm has your correct address. Please note: the backpay check goes void on July 15, 2026. If you do not cash your liquidated damages check, and soon after receipt, your backpay check, as soon as possible and the backpay check goes void, it will take months, if not longer, to receive a replacement backpay check from FDNY.

If you have not received your liquidated damages check, or have lost your check, please contact McGillivary Steele Elkin immediately by completing the address update and check reissue form that can be found by clicking here.
